Terms and Conditions
Welcome to REJEN Wellness and Recovery Studio "A place to regenerate and rejuvenate."
All terms and conditions included in this document relate to both members and casual visitors/sessions.
These Terms, together with our Waiver, form our contract with you, and sets out our obligations as a service provider and your obligations as a customer. You cannot use our Services unless you agree to these Terms.
1. Booking
Our booking policies and schedules are subject to change should it be required; currently casual and membership sessions can be booked any time in advance and rescheduled up to four hours prior to your session.
All session bookings require the creation of an online account. When you create an account, you agree that you are solely responsible for your account security and privacy and that all information provided to us is accurate and up to date.
You will receive a booking confirmation via email or SMS setting out the details of your booking including instructions for studio and services use.
1.1. Payments
All casual sessions must be paid for in full when the services are booked and/or all member fees must be up to date prior to boking.
Access to the studio will only be granted after payment has been made.
We accept the following payment methods:
Credit Card;
Debit Card; and
Direct Debit.
When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument
1.2. Rescheduling & Cancellation
Session cancellation is not permitted.
All sessions can be rescheduled up to four hours prior to your session.
Casual sessions that cannot be rescheduled at the time will be issued to your account as a credit to rebook at a later date.
Refunds will only be granted if you are unable to attend for medical reasons and provide a medical certificate that you are unfit to use our services.
It is your responsibility to reschedule bookings, no shows will not be refunded or credited to your account.
1.3. Cancellation by REJEN
Where your session is cancelled due to circumstances out of control of [legal name], including but not limited to, power outage or system failure, your account will be credited to re-book at a later date.
Refunds will be issued where re-booking is deemed unreasonable.
2. Studio Usage
Sessions are structured to provide continuity of service for all members and visitors, so please be mindful of your booking times to be courteous of all other members. Our visitor’s and member’s cooperation will provide confidence that bookings will run on time for the duration of the day in turn providing a pleasant experience for all visitors and members.
Any damages to our facilities or equipment may result in legal action being taken, liability including all expenses for legal fees, plant and equipment replacement cost, financial losses etc.
2.1. Arrival and Access
We ask that you please arrive 5 minutes before your allocated start time to put your things away and use rest rooms.
Access to the property is via automated gates. You do not need any special access to the gates.
Access to the studio will be via our App and reader on the studio door. Access will only be granted at the time of your booked session/s.
We recommend using a wet bag to hang on provided hooks in the wet areas to keep your personal items dry. Personal items may also be stored in the cubbies provided.
2.2. Etiquette & Obligations
We expect our customers to conduct themselves in a safe and respectful manner to ensure a positive experience and safe environment for all customers and staff and we will do the same.
Should a person conduct themselves in a manner we deem to be unsafe, not aligned with our rules and regulations, unlawful or in any way places the facility, customers and staff at risk will have their membership terminated or refused service.
We may attempt to remedy any situation prior to taking this action at our discretion.
By booking our services you agree that you:
You will be considerate and respectful to all studio visitors and staff.
You will not access studio or use our services whilst under the influence of drugs or alcohol
You will not smoke or vape within the studio.
Will respect our premises and equipment and will be liable for any damage caused to the premises or equipment by your actions or negligence or that of any person you let into the premises. We reserve the right to charge for the repair or replacement cost of any damage.
Leave the studio in the same state as you found it.
Return used towels to the laundry baskets after use.
Not adjust the settings on any equipment.
Our facility is a public space so please ensure you wear appropriate clothing throughout the facility including swim wear and or active wear. A change room and toilet are available for changing in private.
2.3. Studio Departure
We ask that you allow enough time to change after your session if required and exit the studio within 5 minutes of the end of your session time.
You will be required to ensure the studio door is closed as you exit the studio.
2.4. Health and Safety
Our staff provide advice with duty of care in mind and follow all health and safety guidelines and rely on your disclosure of all medical history to be accurate and up to date. All advice is of a general nature and recommend you consult with your doctor.
We are unable to service those with serious medical conditions such as pregnancy, cancer, heart disease.
We remind you to stay hydrated throughout your services to avoid heat stress on your body. Filtered water is available in the studio.
REJEN adheres to all health and safety industry protocols to ensure a clean and sanitary environment.
Visitors and members are required to:
Seek professional medical advice when they are engaging in any new activities such as those provided at REJEN, a waiver will need to be completed at the time of booking.
Sit on a towel (provided) in the infrared sauna.
Shower after the sauna prior to using the Cold plunge between the use of the sauna and/or ice bath. A separate larger towel (also provided) may be preferable.
Towel off between equipment to avoid water pooling in common areas
Members are not permitted to:
Add any product to our ice plunges including but not limited to bubbles and essential oils to ensure safe water for all.
Use aerosol sprays indoors to ensure air quality and respiratory health for all.
Use alcohol, drugs, smoking and vapes.
Use our ice plunges with any open wounds or while menstruating.
REJEN reserves the right to refuse service to anyone that does not maintain good hygiene or does not adhere to our policies.
3. Membership
At REJEN we offer casual sessions, session packs and membership models to allow you in create wellness & recovery rituals that suit your lifestyle whether you are looking for the benefits of on-going sessions or need a one-off session to recover after some hard work or workout.
The memberships we offer will be set out on our website including details of membership features, limitations and fees.
Membership can be upgraded or downgraded at any time through your account. Any changes to your membership will take effect from the beginning of the next billing cycle.
Membership is for individual use only and cannot be shared. Sharing your membership or inviting non-members to the studio will result in a $200 fee and immediate termination of your membership with no further reimbursement.
Any changes to our membership features, policies and procedures will be sent to members in writing.
3.1. Membership Fees
You agree to recurring weekly direct debit payments that will be deducted from your nominated account or card.
You understand that your membership is a four-week minimum commitment (minimum term) that will auto renew on an ongoing basis unless cancel as per our cancellation Terms or otherwise terminated at the discretion of management.
There will be no additional hidden fees. If your membership payment is unsuccessful, we will contact you to rectify the payment or send you notification of a reattempt. Access will be suspended until payment is made in accordance with these terms.
3.2. Membership Cancellation
We require 14 days’ notice to cancel your membership. If you do not cancel your membership, it will automatically rollover and your regular direct debit payments and access will continue.
If you do need to cancel for any reason, please ensure you cancel your membership via our App or alternatively email us at info@rejen.com.au at least 14 days prior to the minimum commitment date.
A confirmation of your cancellation will be sent once this is done. If you do not receive a confirmation this means we have not received your request so, please reach out via phone or check the email address and resend.
3.3. Membership Hold/Pause
Membership holds may be requested, hold time will accrue in increments of 2 weeks every 12-week period, up to 8 weeks hold time annually from the commencement date of your membership.
Please note that any unused hold time will not be rolled over year on year. For any other hold requests please speak to our friendly team who will aim to assist you with a solution.
2.4. Member No Shows
Our no-show policy is that we will send you a friendly reminder of your obligations as a member to please cancel inside the 4-hour window should you not be able to attend; 3 no shows will result in a week's pause to your service at full fees charged.
3. Liability and Warranties
3.1. Indemnity
Rejen Wellness and Recovery and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of our website, studio or services or your violation of these Terms.
3.2. Liability
All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide.
You will be required to complete a liability waiver at the time of booking.
In summary you accept all liability when engaging in REJEN’s wellness and recovery and understand that there is risk associated with all health and wellness services and assume this risk when participating.
You have disclosed any relevant health information that pertains to the use of our facilities to ensure no contraindications.
We cannot guarantee individual results nor seek to make claim to the benefits an individual will receive, rather relay information that is available and documented publicly about equipment and the benefits a customer may experience. Information provided is general and does not replace advice from a medical practitioner.
3.3. Warranties
By booking our services, you understand and agree that:
You are 16 years old or older.
You are solely responsible for determining the suitability of our services, your reliance on any information provided to you by us is at your own risk.
You have read and understood, and will follow our instructions, rules and guidelines in the provision of our services.
You will not remove anything from our premises without our consent and we reserve the right to charge you for any items removed.
You will provide us all information (including your medical history) reasonably necessary to enable us to safely provide our services and that the information you provide to us is true, accurate and complete
We cannot guarantee results of any of our services.
Your participation in the services may expose you to the risk of physical harm or personal injury or death.
You will comply with these Terms, all applicable Laws and our reasonable requests.
We may remove you from our premises or suspend or terminate access to our services if we consider that your behaviour constitutes a breach of any of these Terms.
4. Privacy, Confidentiality
Our full Privacy policy is available on our website. In summary, we collect personal information from you so that we can provide our Services to you.
By providing Personal Information to us, you acknowledge we will collect, hold, use and disclose your Personal Information in accordance with our Privacy Policy
If you do not provide your Personal Information to us, you may not be able to provide our Services to you.
5. General
5.1. Applicable Law
These Terms are governed by the laws of the State of New South Wales.
5.2. Australian Consumer Law
Certain legislation, including the Australian Consumer Law, and similar consumer protection laws and regulations, may confer you with rights, warranties, guarantees and remedies relating to the supply of the Services by us to you which cannot be excluded, restricted or modified (Consumer Law Rights). To the extent that you maintain Consumer Law Rights at Law, nothing in these Terms excludes those Consumer Law Rights.
Subject to your Consumer Law Rights, we provide all material, work and services (including the Services) to you without conditions or warranties of any kind, implied or otherwise, whether in statute, at Law or on any other basis, except where expressly set out in these Terms.
This clause will survive the termination or expiry of these Terms.
5.3. Severability
If at any time any of the provisions set forth in these Terms are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms. All other provisions will not be affected by the removal and the rest of these Terms will still be considered valid.
5.4. Amendment
These Terms may be amended from time to time to maintain compliance with the law and to reflect any changes to the way we operate our website and studio. We will notify users by email of changes to these Terms or post a notice on our website.
5.5. Force Majeure
Neither you or Rejen Wellness and Recovery will be liable for any delay or failure to perform their obligations under these Terms if such delay or failure is caused or contributed to by a Force Majeure Event.
6. Definitions
Australian Consumer Law means the Australian consumer laws set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), as amended, from time to time.
Force Majeure Event means any event or circumstance which is beyond a Party’s reasonable control including but not limited to, acts of God including fire, hurricane, typhoon, earthquake, landslide, tsunami, mudslide or other catastrophic natural disaster, civil riot, civil rebellion, revolution, terrorism, insurrection, militarily usurped power, act of sabotage, act of a public enemy, war (whether declared or not) or other like hostilities, ionising radiation, contamination by radioactivity, nuclear, chemical or biological contamination, any widespread illness, quarantine or government sanctioned ordinance or shutdown, pandemic (including COVID-19 and any variations or mutations to this disease or illness) or epidemic.
Law means all applicable laws, regulations, codes, guidelines, policies, protocols, consents, approvals, permits and licences, and any requirements or directions given by any government or similar authority with the power to bind or impose obligations on the relevant Party in connection with these Terms or the supply of the Services.
Liability means any expense, cost, liability, loss, damage, claim, notice, entitlement, investigation, demand, proceeding or judgment (whether under statute, contract, equity, tort (including negligence), indemnity or otherwise), howsoever arising, whether direct or indirect and/or whether present, unascertained, future or contingent and whether involving a third party or a Party to these Terms or otherwise.
Personal Information means information or an opinion, whether true or not and whether recorded in a material form or not, about an individual who is identified or reasonably identifiable.
Premises means the address where our Services are provided.
Services means hot and cold therapies, including but not limited to, sauna heat therapy, ice bath/cold plunge bath cold therapy.
Terms means these terms and conditions and any documents attached to, or referred to in, each of them.
Waiver means our waiver provided to you.
